Draft — written as a starting point, not reviewed. Bloom's previous site had no real terms of use, so there was nothing to carry over. This is scaffolding written to the right shape so an attorney has something to mark up. It is not legal advice and should not go live as written.
These terms apply to your use of this website. By using the site, you agree to them. If you do not agree, please do not use the site.
Who we are
Bloom Fitness Corporation is a 501(c)(3) nonprofit organization based in Houston, TX. Throughout these terms, "Bloom", "we", and "us" mean that organization.
Using this site
You may use this site to learn about our programs, find a location, register interest in a class, make a donation, apply to partner with us, and read the material we publish. You agree not to:
- Use the site in a way that breaks the law or infringes anyone's rights
- Attempt to gain unauthorized access to any part of the site or its systems
- Interfere with the site's operation, security, or availability
- Collect information about other users, or scrape the site for commercial purposes
- Misrepresent your identity or your affiliation with any person or organization
Participation, health, and assumption of risk
This is the part of these terms that does real work, so please read it.
Bloom classes involve physical activity. Physical activity carries risk, including the risk of injury. Adaptive programming reduces barriers to participation; it does not remove the risks that come with movement.
Before beginning any Bloom program, the athlete, their family, or their care team should talk with a physician about whether the activity is appropriate, and should tell the instructor about any condition, medication, or support need that affects safe participation.
Nothing on this website is medical advice. Descriptions of classes, benefits, and outcomes are general information about our programming, not a clinical recommendation for any individual.
Instructors may adapt, limit, or decline participation in an activity when they judge it necessary for the safety of an athlete or the group.
Registration for an in-person class may require a separate signed waiver, and where an athlete has a legal guardian or authorized representative, that waiver may need to be completed by them. Bloom is confirming what that process looks like; this website does not collect a waiver.
Donations
Donations are processed by a third-party payment provider on their own systems. Their terms and privacy policy govern the transaction. Unless we state otherwise at the time you give, contributions are not refundable and no goods or services are provided in exchange. Details of our tax status appear on the Legal & Accessibility page.
Our content
The text, images, video, logos, and design of this site belong to Bloom or to the people who licensed them to us, and are protected by copyright and trademark law. You may read, share, and link to our material. You may not republish it commercially, present it as your own, or use the Bloom name or logo to suggest a partnership or endorsement that does not exist, without our written permission.
If you believe material on this site infringes your copyright, email info@bloomfitness.org with enough detail to identify the work and where it appears, and we will look into it promptly.
Anything you send us
If you send us a story, photo, testimonial, or other material, you confirm you have the right to send it and you give us permission to use it in our communications about Bloom's work. We will not publish an athlete's name, image, or story without the consent required for that person. Tell us if you want something withdrawn and we will remove it from anything we control going forward.
Other sites we link to
We link to other organizations, partner locations, and service providers. We do not control those sites and are not responsible for their content, their practices, or anything you do there.
Availability and accuracy
We work to keep this site accurate and available, but we do not guarantee either. Class schedules, locations, and events change. Confirm details with the location before you travel.
Limits on our liability
To the fullest extent the law allows, Bloom is not liable for indirect, incidental, or consequential damages arising from your use of this website. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence.
This section, the governing-law section, and the participation section are the three an attorney should look at hardest.
Accessibility
We build this site to be usable by as many people as possible. What we aim for, what we know still needs work, and how to tell us about a barrier are on our Accessibility Statement.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
Changes to these terms
We may update these terms. The current version always lives at this address, and the date at the top tells you when it last changed.
